Terms of Service

1. Acceptance of terms
By downloading, installing, accessing, or using the PourIt mobile application, website (pourit.app), or related services (collectively, the "Service"), you agree to these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Service.
These Terms are an agreement between you and Jahanshasys, a British Columbia, Canada business operating under the trade name "PourIt" ("PourIt," "we," "us," or "our").
2. The Service
PourIt provides:
- A searchable database of cocktail recipes
- Personal favourites and recipe storage
- Team / organization recipe sharing and related tools
- AI-assisted recipe generation (subject to usage limits)
- Free tier with ads. Where offered, PourIt Pro (individual) via mobile in-app purchase and Team / Enterprise via web subscription. Paid options may not be available in all app versions or regions.
We may modify, suspend, or discontinue features with reasonable notice where practicable. The Service is informational and does not sell, ship, or serve alcoholic beverages.
3. Eligibility and age
The App is rated 17+ on the App Store and Mature on Google Play because it contains alcohol-related content. A one-time age gate asks you to confirm you are of legal drinking age in your jurisdiction.
By using the Service, you represent that:
- You are of legal drinking age in your province, territory, state, or country of residence; and
- You will not use the Service to encourage or facilitate service of alcohol to minors or to intoxicated persons.
Legal drinking age varies by jurisdiction (for example, 18 in Alberta, Manitoba, and Quebec; 19 in other Canadian provinces and territories). You are responsible for knowing and following the law where you live.
The Service is not directed to children under 13. See our Privacy Policy for COPPA-related statements.
4. Accounts
- You may use limited guest features without an account, or create an account with Google, Apple, or email/password.
- You are responsible for activity under your account and for keeping credentials secure.
- You may delete your account in-app (Settings → Account → Delete Account). Deletion is permanent for your personal account data, subject to retention described in the Privacy Policy.
- We may suspend or terminate accounts that violate these Terms. Where practicable we will provide notice, except for serious or repeated violations or legal risk.
5. License to use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal or internal business purposes. You may not copy, reverse engineer (except to the extent permitted by law), resell, scrape at scale, or misuse the Service.
6. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose
- Submit false, misleading, harmful, or infringing content
- Attempt unauthorized access to systems, accounts, or data
- Use bots or scrapers in a way that harms the Service or violates rate limits
- Harass or abuse others
- Circumvent security, billing, or access controls
- Promote irresponsible or excessive alcohol consumption, or use the Service to facilitate service of alcohol to minors or intoxicated persons
- Impersonate any person or misrepresent affiliation
7. User-generated content
You retain ownership of recipes and other content you create. By submitting content, you grant Jahanshasys a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, and use that content to operate and promote the Service. You may remove content or delete your account to stop future use of your personal content where technically feasible.
Content contributed to an organization may remain available to that organization after you leave, unless an organization administrator removes it. Organization admins may manage member access and organization content.
We may remove content that violates these Terms or applicable law.
8. Intellectual property
The Service, including design, software, branding, and the curated recipe database as a compilation, is owned by Jahanshasys (operating as PourIt) and protected by Canadian and international intellectual property laws, including the Copyright Act (R.S.C., 1985, c. C-42). "PourIt" and related marks are trademarks of Jahanshasys. Feedback you provide may be used by us without obligation to you.
9. AI-generated content
AI recipe features generate suggestions from your inputs. Outputs may be inaccurate or unsafe if prepared without review. You are solely responsible for reviewing ingredients, allergens, measurements, and local legality before preparation or consumption. AI features are subject to tier-based usage limits. We do not claim ownership of recipes generated solely from your request for your personal use; do not present unmodified AI output as original human creative work where that would be misleading.
10. Subscriptions, purchases, and billing
10.1 PourIt Pro (individual — mobile)
Where PourIt Pro is offered (it may not be available in every app version or region), Pro subscriptions are purchased through the Apple App Store or Google Play. Payment is processed by Apple or Google under their terms. We do not receive your full payment card details. Manage or cancel in your device subscription settings:
- iOS: Settings → [Your Name] → Subscriptions
- Android: Google Play → Payments & subscriptions
Subscriptions typically auto-renew unless cancelled at least 24 hours before the end of the current period (subject to store rules). Refunds are handled by Apple or Google per their policies.
10.2 Team and Enterprise (organizations)
Team plans are purchased on pourit.app and billed via Stripe. You authorize recurring charges for the selected Team plan until you cancel. Cancel through your account dashboard; access generally continues until the end of the paid period. Enterprise services, if offered, require a separate written order or agreement and are billed under that agreement; contacting sales does not create a subscription or promise an unlisted capability. Except where required by applicable consumer law, organization plan fees for a started billing period are non-refundable, but you may cancel to stop future renewals.
As organization owner/admin you control member access; private recipes and team content belong to the organization; deleting your personal account does not automatically delete the organization — transfer ownership first if needed; you are responsible for your members' compliance with these Terms.
10.3 Pricing and trials
Prices are shown at purchase in the currency displayed (Team plans are typically priced in Canadian dollars). Applicable taxes (including GST, HST, PST, QST, or other sales taxes) may be added as required by Canadian or other law and as handled by the app store or Stripe. Free trials, if offered, convert to paid unless cancelled before the trial ends. We may change prices with notice to existing subscribers before renewal where required.
11. Advertisements
Free-tier users may see ads served by Google AdMob. Premium subscribers do not see those ads. We do not control third-party ad creative. Ad personalization can be limited in device settings (see Privacy Policy).
12. Alcohol responsibility and disclaimers
PourIt provides cocktail recipes and bartending information for educational, professional reference, and entertainment purposes only. We do not sell, distribute, deliver, manufacture, or serve alcohol. We are not a liquor licensee, importer, retailer, or bar/restaurant operator.
12.1 Personal use
- Drink responsibly and only in accordance with the laws of your province, territory, or country. Do not drink and drive.
- You must be of legal drinking age where you live before preparing or consuming alcoholic beverages.
- Recipes, measurements, techniques, and education topics are informational. Outcomes vary with ingredients, equipment, and skill.
- Allergen, dietary, and ingredient information may be incomplete or outdated. Verify every ingredient yourself before preparation or service.
12.2 Professional and commercial use (Canada and elsewhere)
If you use the Service at work — including as a bartender, bar manager, owner, trainer, or organization member on a Team plan — you and your employer or venue remain solely responsible for compliance with all applicable liquor and hospitality laws. That includes, without limitation:
- Provincial and territorial liquor statutes and regulations, and rules of the applicable liquor authority (for example, BC Liquor and Cannabis Regulation Branch, AGCO in Ontario, Régie des alcools, des courses et des jeux in Quebec, and equivalent bodies elsewhere in Canada)
- Your liquor primary, food primary, or other licence conditions, municipal bylaws, and house policies
- Checking identification, refusing service to minors, and refusing or stopping service to intoxicated persons
- Responsible service, overservice, occupancy, and related duties that apply to commercial hosts and servers where you operate
- Staff training and certification requirements that apply in your province or territory (for example programs commonly known as Serving It Right, Smart Serve, ProServe, or equivalent). PourIt education content is general professional reference and is not a substitute for any required government or regulator-approved server training or certification
- Accurate menus, allergen disclosure, and safe food/beverage handling at the point of service
PourIt does not supervise service of alcohol, does not control your premises, and is not a party to any guest or patron relationship. Decisions to prepare, recommend, pour, or serve any drink are yours (and your venue's) alone.
12.3 No professional advice
Nothing in the Service is medical advice, legal advice, regulatory advice, insurance advice, or a substitute for licensed bartending, food-safety, or server certification. Organization tools (SOPs, training tracks, duties, menus, batch lists) are productivity features you configure; we do not warrant that they meet any particular statutory or insurer standard.
12.4 Assumption of risk
To the maximum extent permitted by applicable law, you assume all risk arising from preparation, consumption, recommendation, or service of beverages using information from the Service, and from any reliance on education or AI-generated content. Jahanshasys is not liable for injuries, property damage, regulatory penalties, licence consequences, employment claims, or third-party claims arising from alcohol service or consumption connected with your use of the Service — except to the extent such liability cannot be limited under applicable law.

13. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW OF CANADA AND THE PROVINCE OF BRITISH COLUMBIA (AND ANY OTHER LAW THAT MANDATORILY APPLIES TO YOU), THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that recipes, education content, organization tools, or AI outputs are accurate, complete, current, or suitable for any particular venue, guest, or regulatory requirement. We do not warrant uninterrupted or error-free operation. Third-party services (Firebase, AdMob, Apple, Google, Stripe, AI providers) may affect availability.
If you are a consumer resident in Canada, nothing in these Terms excludes warranties, conditions, or remedies that cannot be excluded under the applicable provincial or territorial consumer protection statute (including, where they apply, statutes in British Columbia, Alberta, Ontario, Quebec, and other provinces and territories).
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY THE LAWS OF CANADA AND BRITISH COLUMBIA (AND ANY OTHER LAW THAT MANDATORILY APPLIES TO YOU), JAHANSHASYS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; OR FOR LOSS OF DATA, PROFITS, REVENUE, GOODWILL, BUSINESS OPPORTUNITY, OR ANTICIPATED SAVINGS; OR FOR REGULATORY FINES, LICENCE SUSPENSION, OR THIRD-PARTY CLAIMS ARISING FROM ALCOHOL SERVICE OR CONSUMPTION — WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE — ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
SUBJECT TO THE SAME LIMITS OF APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO JAHANSHASYS FOR THE SERVICE IN THE TWELVE (12) MONTHS IMMEDIATELY BEFORE THE CLAIM (EXCLUDING AMOUNTS PAID TO APPLE, GOOGLE, OR OTHER APP STORES, AND EXCLUDING TAXES), OR (B) FIFTY CANADIAN DOLLARS (CAD $50).
These limitations apply to the fullest extent permitted in each Canadian province and territory. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including (where such rules apply) liability for fraud or fraudulent misrepresentation, or for death or personal injury caused by our negligence, or rights that cannot be waived under provincial consumer protection legislation.
15. Indemnity
To the extent permitted by applicable law (and without limiting non-waivable consumer rights), you agree to indemnify and hold harmless Jahanshasys and its officers, directors, employees, contractors, and agents from and against claims, damages, losses, penalties, and reasonable legal fees arising out of or related to: (a) your use of the Service; (b) content you submit; (c) your violation of these Terms or applicable law; (d) your infringement of third-party rights; or (e) preparation, recommendation, service, or consumption of alcoholic or non-alcoholic beverages in connection with your use of the Service, including claims by guests, patrons, employees, regulators, or other third parties.
If you use the Service for a business or organization, you represent that you have authority to bind that organization to these Terms where you accept them on its behalf, and the organization is responsible for its staff's use of organization features.
16. Governing law and disputes
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law rules that would require another jurisdiction's law. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Subject to mandatory consumer protection rights in your province or territory of residence in Canada (or other country of residence), you and Jahanshasys attorn to the exclusive jurisdiction of the courts of the Province of British Columbia, sitting in Vancouver, for disputes arising from these Terms or the Service. Canadian consumers may also have the right to bring claims in the courts of their province or territory of residence where consumer law so provides.
Nothing in these Terms waives rights that cannot be waived under applicable Canadian provincial or territorial consumer protection legislation (including, where applicable, rights regarding class proceedings or restrictions on mandatory arbitration). After a dispute arises, the parties may mutually agree in writing to mediation or arbitration seated in British Columbia.
17. Canadian consumer and language notes
If you reside in any province or territory of Canada, mandatory consumer protection statutes may limit or override certain clauses of these Terms (including some liability limitations, disclaimer language, dispute clauses, or cancellation/refund rules). Those non-waivable rights control to the extent of any conflict. For greater certainty, this includes consumer-protection regimes in British Columbia, Alberta, Saskatchewan, Manitoba, Ontario, Quebec, New Brunswick, Nova Scotia, Prince Edward Island, Newfoundland and Labrador, Yukon, the Northwest Territories, and Nunavut, as applicable to you.
Quebec. If you are a consumer residing in Quebec, certain provisions of the Consumer Protection Act (CQLR c. P-40.1) and related rules may apply and prevail over inconsistent terms. Where Quebec law requires, we will make a French version of these Terms available; until then, if you require a French copy, contact [email protected].
Business or organization customers (including Team and Enterprise subscribers purchasing for commercial use) are not consumers for the purpose of those statutes to the extent the law classifies the transaction as a business transaction.
18. CASL
Commercial electronic messages will be sent only with consent as required by Canada's Anti-Spam Legislation (CASL), S.C. 2010, c. 23. You may withdraw marketing consent at any time. Transactional and security messages may continue as needed.
19. Changes
We may update these Terms from time to time. For material changes we will update the date above and, where practicable, provide in-app or email notice. Continued use after the effective date constitutes acceptance. If you do not agree, stop using the Service and delete your account.
20. Miscellaneous
- Force majeure: we are not liable for delays caused by events beyond reasonable control, including third-party platform outages.
- International use: the Service is operated from British Columbia, Canada and offered globally via app stores. You are responsible for local compliance.
- Severability: if a provision is unenforceable, the remainder stays in effect.
- Entire agreement: these Terms and the Privacy Policy are the entire agreement regarding the Service.
- Assignment: we may assign these Terms in connection with a merger, acquisition, or asset sale; you may not assign without our consent.
- Language: these Terms are in English and may be made available in French. Except where prohibited by law (for example, certain Quebec requirements), the English version prevails if there is a conflict.
